1. Definitions and Background

1.1 In these Booking Terms and Conditions “you” and “your” means the person named as Party Leader on the Booking Form (including anyone substituted at a later date). “We” “us” “our” and “property”means Buttercup Cottage, Main Street, Great Longstone, Derbyshire, DE45 1TG.
1.2 Before booking through us, please read these Booking Terms and Conditions carefully and all other information relevant to your booking as shown on our website.
1.3 Once your booking has been confirmed, you agree and acknowledge the terms and conditions as set out in this agreement.
1.4 A contract is formed between you and us when we issue you with a Booking Confirmation for the property and other goods and services (if applicable). No booking shall be binding on Buttercup Cottage until we issue you with a Booking Confirmation.

2. Availability and Booking

2.1 All bookings are subject to availability.
2.2 Your booking will be considered as accepted only when we have issued the Booking Confirmation to you. We will do so electronically by e-mail, by text or by post.
2.3 Once received, you should check the details on the Booking Confirmation carefully and let us know immediately if anything is incorrect.

3. Prices

3.1 All prices quoted or otherwise advised to you include all UK taxes or governmental levies that apply at the time of your booking. If, after a Booking Confirmation has been issued there are changes to such taxes or levies, we reserve the right to pass on the cost to you.
3.2 The price of the accommodation includes the following: central heating and power, hot water, duvets, bed linen and towels, double oven and hob, microwave, toaster, fridge/freezer, washing machine, dishwasher, 1 freeview television, radio/cdplayer with Bluetooth connectivity,2 hairdryers.
3.3 The price also includes free WiFi .There is also a small supply of cleaning materials including dishwasher tablets, washing up liquid, wash powder and fabric softener.

4. Payment

4.1 A deposit equivalent to 25% of the total cost of your holiday is required to confirm your booking.
4.2 The balance of the cost of your holiday must be received by us no less than 28 days prior to the start date for your holiday. If you fail to do this, we may treat this as a cancellation and re-let the Property to another person (see clause 5 – Cancellation by You).
4.3 If you book the Property within 4 weeks of the Start Date, the full cost of the holiday must be paid at the time of booking.
4.4 A charge of £20 per dog will be added to your balance where applicable. Guide dogs or hearing dogs are free of charge.
4.5 Charges for additional goods and services will be added to your balance where applicable.
4.6 We accept payments by Bank Transfer and cheques. For bank transfers, bank details will be provided on request. If payments are made by this method from outside of the UK then bank charges will be levied by our UK bank. This will be passed onto you as a booker at the actual cost. Please note that your bank may also charge you for international payments, in this case Buttercup Cottage will not be accountable.

5. Arrival/Departure

5.1 Your accommodation will be available to you from 3.00pm on the scheduled day of arrival and you are required to vacate the premises by 10.00am on the scheduled departure date.
5.2 Earlier check-in and later departure times are sometimes possible and strictly by prior arrangement only – please enquire.
5.3 The property is fully cleaned prior to your arrival. Guests are requested to leave the accommodation in the same clean and tidy condition in which it was found on arrival.

6. Keys

6.1Keys will be posted to guests once full payment has been received and approx. 10 days prior to your arrival. These must be returned within 7 days of your scheduled departure date,a postage paid addressed envelope is provided.
6.2 In the event of lost or stolen keys, you will be required to pay all costs and charges incurred in gaining entry to the property and replacing the keys and / or locks, subject to a minimum charge of £20.00.
6.3 If you fail to return the keys when due, we may replace the keys and / or locks and you will be required to pay the costs of such replacement on demand.

7. Occupancy

7.1 The maximum occupancy of the cottage is strictly 4 persons plus 1 baby (you are required to provide your own travel cot although a high chair is available to hire on request).
7.2 The number of persons occupying the cottage must never exceed those booked.
7.3 You and the members of your party will occupy the property as a private holiday home only and that, as such, no Assured Tenancy or statutory periodic tenancy will arise (as defined in the Housing Acts);

8. Smoking

8.1 Buttercup Cottage operates a strict ‘no smoking’ policy within the property. If you do smoke this will be regarded as a breach of these booking terms and conditions and we will terminate your booking and you will be asked to vacate the property.
8.2 If there is evidence after your departure of smoking within the property, we will contact you to recover any costs incurred for specialist cleaning, repair or replacement of damage by you to our property and any lost revenue based on the cost of the room for any period that it is unsuitable for letting.

9. Pets

9.1 Pets are welcome at Buttercup Cottage by prior arrangement and provided that they are house trained and well behaved. Guests must provide suitable bedding however 2 feeding bowls, a dog towel, fleece and feeding mat are provided.
9,2 With respect to our property and other guests, pets are not allowed upstairs or on the furniture and pets must not be left alone in the property or unattended at any time.

10. Changes to your Booking

10.1 You should let us know immediately if you wish to make any changes once a Booking Confirmation has been issued.
10.2 Your change requests will be accommodated wherever reasonably possible and will be subject to the prevailing rate which may be different to the price you have already paid.

11. Cancellation by You

11.1 You should telephone us as soon as possible if you wish to cancel your booking after a Booking Confirmation has been issued.
11.2 Please note that in the event of a cancellation by you, all deposits paid are non-refundable.
11.3 In addition, please refer to the following table of charges that are applicable for cancellations made by you;

Cancellation Notice Period Charges (No: days prior to your arrival)

  • Up to 29 days 25% of total holiday cost
  • Between 28 days & 22 days 40% of total holiday cost
  • Between 21 days & 15 days 60% of total holiday cost
  • Between 14 days & 8 days 80% of total holiday cost
  • Between 7 days & arrival day 100% of total holiday cost

11.4 We will promptly refund any money due to you that you have paid to us.
11.5 We strongly recommend that you take out travel/cancellation insurance which is inexpensive and can be obtained from any good broker.

12. Cancellation by Us

12.1 Where circumstances beyond our control require us to alter or cancel your booking, we will let you know as soon as possible and:-
12.1.1 We will endeavour to arrange and offer you alternative accommodation of a similar type and standard, in a similar location and of similar cost; or
12.1.2 If alternative accommodation is unavailable or unacceptable to you, we will refund all sums paid by you and we shall not be under any further liability to you.
12.2 Where we offer you alternative accommodation and you accept, any difference in the cost of the alternative accommodation will be refunded to you or will become payable by you (as appropriate) on the date that new Booking is confirmed.

13. Damages, Breakages & Disturbances

13.1 Please take care with our property and be aware that you are responsible and liable for any breakages or damage you cause to the property, its fixtures, fittings and contents.
13.2 In the event of minor and accidental damage and breakages e.g. crockery, glassware etc, please report these as soon as they occur so that items can be repaired or replaced prior to the next guests arrival. We do not normally charge for minor breakages.
13.3 In the event of significant damage and breakages, please report these as soon as they occur so that damages can be repaired and items replaced prior to the next guests arrival. We reserve the right to charge you a fair cost of repair or replacement and invoice you accordingly.
13.4 You and your party will not cause or permit any nuisance or annoyance to the owners or occupiers of adjacent property and will not cause damage to them;
13.5 If you fail to keep to the terms of this agreement (for instance, you cause noise and disturbance, serious damage to or in the property or you significantly change the composition of your party or exceed the numbers of persons permitted to stay at the property), we may terminate the agreement immediately and you and your party may be required to leave the property immediately. In these circumstances, we will not refund any monies you have paid in respect of your booking and we will not be liable to you for any consequential costs.

14. Liability

14.1 We retain the right to access the property at any time if deemed necessary to so.
14.2 We will not accept any liability for noise or disturbance caused to you which originates from beyond the boundaries of the property or which is beyond our control. If a source of obvious noise has been identified by or notified to us before your arrival, we will let you know.
14.3 We cannot accept liability for the breakdown of mechanical equipment such as pumps and boilers nor the failure of public utilities such as water, gas and electricity. If such matters arise during your stay at the property, please notify us as soon as possible and we will aim to resolve the matter promptly and to your satisfaction.
14.4 All statements and information in this agreement is given in good faith, being true and correct to the best of our knowledge and belief. We accept no liability in the event of any such statement or information being untrue or incorrect. Similarly, we cannot accept liability for any changes or closures of local services or attractions, as these are outside our control.
14.5 The terraced area is elevated and is not suitable for wheelchair access and/or may not be suitable for people with restricted mobility. Young children should be supervised at all times. We are unable to accept any liability for damage or personal injury sustained through undue care and attention of the external grounds.

15. Lost Property

15.1 If you have left behind any personal items, please contact us immediately.
15.2 If claimed, lost property will be returned to the owner at the owners expense.
15.3 Lost property will be held for a period of 1 month after which it will be donated to a local charity shop or disposed of if appropriate.

16. Complaints

16.1 If you have any complaints about our property or any of our services, you should raise these with us as soon as reasonably possible. We will endeavour to resolve any issues raised promptly and to your satisfaction.

17. Marketing Particulars

17.1 We aim to ensure that all information we publish is correct at the date of publication. Occasionally there may be minor differences between the description of the property, its services or the local area. We will let you know as soon as reasonably practical if we consider there are any changes that may materially impact your holiday.

18. Data Protection

18.1 We are the sole data controller of all personal data provided by you. In order to process your booking we need to collect certain personal data from you, which may include “sensitive personal data” about you and members of your party.
18.2 We will not disclose personal data about you (or about your party) to anyone, unless we reasonably believe that we are required to do so by applicable law or regulation.

19. Third parties

19.1 Our relationship is with you and we will not recognise the interest or claim of any other person, unless by law we have to do so.

20. Language and Law

20.1 We will communicate with you in English and the law of England & Wales will apply to this agreement.

21. Changes to Terms

21.1 We reserve the right to change our terms and conditions from time to time. The terms and conditions applicable to your Booking are those in force on the date of Booking (or amendment, as applicable).
